Terms of Service

Tikxz is a self-service technology platform that enables event organisers ("Organisers") to create and manage events, and attendees ("Buyers") to discover and purchase tickets for those events. We are a marketplace intermediary — we do not own, operate, or organise the events listed on our platform.

These Terms apply to all users including visitors, registered users, Buyers, Organisers, and any other persona that interacts with the platform.

To access certain features you must register for an account. By registering you agree to the following:

• Accurate Information: You must provide truthful, accurate, and complete information during registration and keep it up to date.
• Credential Security: You are solely responsible for maintaining the confidentiality of your password. Tikxz will never ask for your password. Any activity under your account is your responsibility.
• One Account: Creating multiple accounts to circumvent suspensions or restrictions is prohibited and will result in permanent termination of all associated accounts.
• Notification of Breach: You must notify us at support@tikxz.com immediately upon discovering any unauthorised use of your account.
• Suspension & Termination: Tikxz reserves the right to suspend or terminate any account at its sole discretion for violation of these Terms, fraudulent activity, or any conduct deemed harmful to the platform or other users, with or without notice.

Since Tikxz facilitates financial transactions, users under 18 may not independently enter into binding agreements on the platform. Organisers are solely responsible for enforcing any age restrictions applicable to their specific events. Tikxz is not responsible for verifying audience age eligibility for individual events.

If we discover that an account belongs to a minor without appropriate consent, we reserve the right to immediately terminate the account and reverse any associated transactions.

The following are strictly prohibited on Tikxz and will result in immediate account termination, IP banning, and where applicable, reporting to law enforcement:

Organisers using Tikxz to list events agree to the following additional obligations:

• Accuracy of Listings: Organisers are solely responsible for the accuracy, completeness, and legality of all event information — including dates, venues, ticket prices, guest lists, and event descriptions. Tikxz is not liable for incorrect information provided by Organisers.
• Permits & Licences: Organisers must hold all necessary government permits, venue permissions, performer licences, and regulatory approvals required by applicable law before listing their event. Failure to do so may result in account termination and legal liability.
• Payout Withholding: Tikxz reserves the right to withhold, delay, or reverse payouts if fraud is suspected, a chargeback is initiated, or an investigation is in progress. Funds may be held for up to 90 days pending resolution.
• Organiser Fees: Platform fees charged to Organisers are non-refundable once the event goes live, regardless of whether the event is subsequently cancelled or modified.
• Event Cancellation by Organiser: If an Organiser cancels an event, they are obligated to issue full refunds to all ticket holders within 7 business days. Tikxz may initiate refunds directly and recover the cost from future Organiser payouts if the Organiser fails to act.
• Tax Compliance: Organisers are responsible for collecting and remitting any applicable taxes (GST, TDS, etc.) on their ticket sales. Tikxz is not a tax agent for Organisers.

Tikxz Platform IP: All content, features, code, design, branding, trademarks, logos, and service marks on the Tikxz platform ("Tikxz IP") are and remain the exclusive property of Tikxz and its licensors. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Tikxz IP without our express prior written consent.

Organiser Content Licence: By uploading event content to Tikxz (including banners, descriptions, images, video, and other media), Organisers grant Tikxz a non-exclusive, royalty-free, worldwide, sublicensable licence to use, display, reproduce, and distribute that content for purposes of operating, promoting, and improving the platform.

Organiser Warranty: Organisers warrant that all uploaded content is original, does not infringe any third-party copyright, trademark, or other proprietary right, and does not violate any applicable law. Tikxz reserves the right to remove any content that is the subject of an IP complaint.

Tikxz is a marketplace platform. Event listings, descriptions, images, schedules, and all other event details are provided entirely by Organisers, not by Tikxz.

Tikxz is not responsible for any loss, disappointment, or damage resulting from inaccurate event descriptions or Organiser misrepresentations. All disputes regarding event content should be directed to the relevant Organiser in the first instance.

Tikxz expressly prohibits the following fraudulent activities on our platform:

• Ticket Scalping: Purchasing tickets in bulk for the purpose of resale at inflated prices (scalping) is strictly prohibited. Accounts found engaging in scalping will be permanently banned and purchases may be cancelled without refund.
• Bot Usage: Using automated scripts, bots, or other software to circumvent purchase limits, queue systems, or access controls is a violation of these Terms and applicable computer fraud laws.
• Fraudulent Chargebacks: Filing a chargeback with your payment provider for a valid purchase ("friendly fraud") will result in permanent account suspension and may lead to legal recovery action for the disputed amount plus associated fees.
• Account Manipulation: Creating or using multiple accounts to circumvent any per-user purchase limits is prohibited.
• Resale Platform Listing: Listing Tikxz-purchased tickets on third-party resale platforms at above face value is prohibited without explicit Organiser consent.

• Currency: All transactions are processed in Indian Rupees (INR) unless otherwise stated.
• Booking Fees: Tikxz charges a platform booking fee on top of the face value ticket price. This fee covers payment processing, platform maintenance, and customer support. Booking fees are non-refundable except where the event is cancelled.
• Payment Processing: Payments are processed by our third-party payment gateway (PhonePe/Razorpay). Tikxz does not store full card numbers. By making a payment you also agree to the payment processor's terms of service.
• Refund Policy: All sales are final. Refunds are issued only if: (a) an event is cancelled by the Organiser; (b) Tikxz determines at its sole discretion that a refund is warranted due to Organiser misrepresentation.
• Refund Timeline: Approved refunds are processed within 5–7 business days of approval and credited to the original payment method.
• Chargeback Prohibition: As noted in Section 8, initiating a chargeback for a valid transaction constitutes fraud under these Terms and may result in account ban and recovery action.

When an Organiser cancels an event, the following obligations and consequences apply:

• Mandatory Refunds: Organisers who cancel must initiate full refunds to all ticket holders within 7 business days of cancellation.
• Tikxz Enforcement: If an Organiser fails to initiate refunds within 7 business days, Tikxz may process refunds directly on the Organiser's behalf and recover the refunded amount from pending or future payouts, along with a penalty fee of up to 10% of the total refunded amount.
• Late Cancellation Penalty: Organisers who cancel within 48 hours of the event start time may be charged an additional late-cancellation fee. This fee will be deducted from any remaining payout balance.
• Repeat Cancellations: Organisers with more than 2 cancellations in any 12-month period may have their account suspended pending review. Tikxz reserves the right to require advance deposits for future events from repeat-cancellation Organisers.
• Partial Cancellations: If an event is modified significantly (e.g., venue change, date change, key performer cancellation) Tikxz may, at its discretion, offer affected Buyers a refund option.

• No Warranties: The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.
• Event Risks: Tikxz is a technology intermediary. We are not liable for any injury, damage, financial loss, or disappointment arising from or in connection with any event listed on the platform. Attendees assume all physical and financial risks associated with attending events.
• Maximum Liability Cap: In any event, Tikxz's total aggregate liability to any user shall not exceed the total amount paid by that user for the specific transaction giving rise to the claim in the preceding 12 months.
• Third-Party Links: The platform may contain links to third-party websites. Tikxz is not responsible for the content, privacy practices, or accuracy of those third-party sites.

You agree to release, defend, indemnify, and hold harmless Tikxz and its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the platform;
• Your violation of any of these Terms;
• Your violation of any third-party right, including intellectual property, privacy, or proprietary rights;
• Any content you submit, post, or transmit through the platform;
• Any event you organise, promote, or facilitate through the platform;
• Any claim that your content or event caused damage to a third party.

Tikxz shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to:

In a force majeure event, our obligations are suspended for the duration of the event. We will make reasonable efforts to notify affected users and resume normal operations as soon as practicable.

Your use of Tikxz is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

• DPDPA 2023 Compliance: Tikxz processes personal data in accordance with India's Digital Personal Data Protection Act (DPDPA) 2023. By registering, you explicitly consent to the collection and processing of your personal data as described in our Privacy Policy.
• Data You Share: We collect data necessary to provide our services — including name, email, phone, payment details (processed by our gateway), and location data for event discovery. We do not sell your personal data to third parties.
• Your Rights: You have the right to access, correct, port, and request deletion of your personal data. Requests should be directed to legal@tikxz.com. Financial records may be retained for up to 7 years as required by Indian financial regulations.
• Data Security: We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss, or misuse. However, no internet transmission is 100% secure, and we cannot guarantee absolute security.
• International Users: Tikxz is operated from India. If you access the platform from outside India (including from the EU), your data will be transferred to and processed in India. EU users may have additional rights under GDPR — contact us at legal@tikxz.com for GDPR-specific requests.

Tikxz reserves the right to update, modify, or replace any part of these Terms at any time at our sole discretion. The updated Terms will be posted at tikxz.com/terms with a revised "Last Updated" date.

Continued Use = Acceptance: Your continued access or use of the platform after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the platform and may request account deletion by contacting support.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

• Jurisdiction: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
• Arbitration: Before initiating any legal proceeding, both parties agree to first attempt in good faith to resolve any dispute through direct negotiation for a period of 30 days. If unresolved, disputes shall be referred to binding arbitration in New Delhi under the Arbitration and Conciliation Act, 1996.
• Class Action Waiver: All arbitration proceedings shall be conducted on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Tikxz.
• Consumer Protection: Nothing in these Terms limits your rights under the Consumer Protection Act, 2019 (India) or any other applicable mandatory consumer protection legislation.
